Law and Jurisdiction
These Terms of Use and your use of the Site are governed by the laws of the State of Georgia, USA, without regard to its choice of law provisions. The courts of general jurisdiction located within Fulton County, Georgia, USA, will have exclusive jurisdiction over any and all disputes arising out of, relating to or concerning these Terms of Use and/or the Site or in which these Terms of Use and/or the Site are a material fact.



Allgemeine Geschäftsbedingungen (AGB)
1. Geltung der Bedingungen
1.1 Unsere Lieferungen, Leistungen und Angebote erfolgen ausschließlich auf Grund dieser Geschäftsbedingungen. Sie gelten auch für alle künftigen Geschäftsbeziehungen, auch wenn sie nicht nochmals ausdrücklich vereinbart wurden. Spätestens mit der Entgegennahme der Ware oder Leistung gelten diese Bedingungen als angenommen. Gegenbestätigungen des Käufers unter Hinweis auf seine Geschäfts- bzw. Einkaufsbedingungen wird hiermit ausdrücklich widersprochen.

1.2 Abweichungen von diesen Geschäftsbedingungen sind nur wirksam, wenn sie von uns schriftlich bestätigt werden.
2. Angebot

2.1 An unsere Angebote halten wir uns 30 Tage gebunden. Preisinformationen sind stets freibleibend und unverbindlich. Bestellungen gelten erst als angenommen, wenn sie von uns schriftlich bestätigt sind. Ansprüche aus abgeschlossenen Verträgen mit uns sind auf Dritte nur mit unserer Zustimmung übertragbar.

2.2 Mündliche Absprachen sind unwirksam. Nebenabreden und Änderungen bedürfen der schriftlichen Bestätigung durch uns.

2.3 Technische und gestalterische Angaben, Beschreibungen und Zeichnungen des Angebotes in Prospekten, Katalogen und schriftlichen Unterlagen sind nur annähernd maßgeblich, soweit sie nicht ausdrücklich als verbindlich bezeichnet oder vom Besteller ausdrücklich zum wesentlichen Bestandteil des Vertrages erklärt worden sind. Abweichungen von den Beschreibungen und Angaben in Prospekten, Katalogen und schriftlichen Unterlagen sowie Modellkonstruktions- und Materialänderungen bleiben vorbehalten, soweit sie nicht im Widerspruch zu ausdrücklichen Zusicherungen stehen und die Durchführung des Auftrages nicht wesentlich verändern. Das Gleiche gilt für Konstruktions- und Materialänderungen. Diese bleiben im übrigem immer dann vorbehalten, wenn sich für den Besteller kein Nachteil gegenüber dem erkennbaren Auftragsumfang und der erkennbaren Auftragsspezifikation feststellen lässt. Unsere Pro¬spektangaben enthalten keine Zusicherung bestimmter Eigenschaften. Von uns zugesandte Muster sind unverbindlich. Mengen- und Qualitätsabweichungen hat der Besteller hinzunehmen, soweit diese Branchen ¬und handelsüblich sind.

3. Preise

3.1 Alle Preise verstehen sich ab Werk, zuzüglich der jeweiligen gesetzlichen Mehrwertsteuer und Gebühren.

3.2 Unsere Preisangaben sind für vier Monate ab dem vertraglich vorgesehenen Lieferdatum, hilfsweise ab Vertragsschluss verbindlich. Nach Ablauf der Viermonatsfrist sind wir berechtigt, die Preise nach Maßgabe der Steigerung der Gestehungskosten und unter Berücksichtigung der Marktentwicklung für gleichartige Produkte anzuheben. Bei einer Anhebung von mehr als 10% ist der Besteller berechtigt, vom Vertrag zu-rückzutreten. Zuvor hat er uns schriftlich die

Ablehnung der Preiserhöhung mitzuteilen und uns für den Zeitraum von 3 Wochen Gelegenheit zu geben, das Preiserhöhungsbegehren für gegenstandslos zu erklären, so dass der Vertrag zu den ursprünglichen Konditionen weitergeführt und abgewickelt wird.

4. Liefer- und -Leistungszeit

4.1 Die von uns genannten Termine und Fristen sind unverbindlich, sofern nicht ausdrücklich schriftlich etwas anderes vereinbart wurde.

4.2 Lieferfristen beginnen mit dem Datum der Absendung der Auftragsbestätigung, keinesfalls jedoch vor Beibringung der vom Besteller zu beschaffenden Unterlagen, Genehmigungen und Freigaben sowie vor Eingang einer vereinbarten Anzahlung. Die Lieferfrist ist eingehalten, wenn bis zu ihrem Ablauf der Liefer¬gegenstand als montagebereit dem Besteller mitgeteilt und die Bekanntgabe eines Montagetermins erbeten wurde. Die Lieferfrist verlängert sich angemessen bei Maßnahmen im Rahmen von Arbeitskämpfen sowie bei Eintritt unvorhergesehener Hindernisse, die außerhalb unseres Einflussbereiches liegen, sofern diese Hindernisse auf die Fertigstellung oder Ablieferung des Liefergegenstandes von erheblichem Einfluss sind.

Dies gilt auch, wenn derartige Hindernisse während eines bereits vorliegenden Verzuges auftreten. Teillieferungen bleiben vorbehalten, soweit sie nicht ausdrücklich ausgeschlossen sind.

4.3 Für Verzugsschäden haften wir nur, soweit diese auf Vorsatz oder grobe Fahrlässigkeit zurückzuführen sind. Liefer- und Leistungsverzögerungen, die durch Verzug von Unterlieferanten bedingt sind, sind bis zu einem Zeitraum von vier Wochen vom Besteller entschädigungslos hinzunehmen, sofern nicht ein
Fixgeschäft vereinbart wurde.

4.4 Soweit kein Fixgeschäft vereinbart ist, kommen wir erst in Verzug, wenn uns der Besteller schriftlich gemahnt und eine angemessene Nachfrist von mindestens vier Wochen gesetzt hat. Der Besteller kann im Falle des Verzuges vom Vertrag zurücktreten. Ansprüche auf Schadensersatz wegen einer Verzögerung bestehen nur, soweit sie auf grobe Fahrlässigkeit unsererseits zurückzuführen sind. Derartige Ansprüche sind unter Ausschluss weiterer Ansprüche begrenzt auf maximal 10% des Wertes der Teile der Gesamtliefe¬rung, die in Folge der Verspätung nicht rechtzeitig oder nicht vertragsgemäß genutzt werden können.


4.5 Wird der Versand oder die Montage durch den Besteller verzögert, werden ihm, beginnend einen Monat nach Versand- bzw. Montagebereitschaft, die durch die Lagerung entstehenden Kosten, mindestens jedoch ein halbes Prozent des Rechnungsbetrages pro Monat berechnet. Der Besteller ist berechtigt nachzuweisen, dass kein oder ein geringerer Schaden eingetreten ist. Wir sind berechtigt, nach fruchtlosem Verlauf einer angemessenen Frist (drei Monate nach vereinbartem Liefertermin) zur Abnahme oder Montage vom Vertrag zurückzutreten und anderweitig über den Liefergegenstand zu verfügen. Dem Besteller werden in diesem Fall 30% des Auftragswertes berechnet.
5. Versand und Gefahrübergang

5.1 Der Versand erfolgt auf Gefahr des Bestellers, soweit nichts anderes vereinbart wurde.

5.2 Die Gefahr geht auf den Besteller über, sobald die Sendung an die über den Transport ausführende Person übergeben worden ist oder zwecks Versendung unser Lager - bei Direktversand den deutschen Einfuhrhafen, bzw. das Lager des Lieferanten - verlassen hat.


5.3 Mit der Absendung der Mitteilung der Versandbereitschaft geht die Versendungsgefahr auf den Besteller über; wir haften nur noch für Vorsatz und grobe Fahrlässigkeit und nur, soweit wesentliche Pflichten zur Durchführung des Versandes missachtet wurden. Der Versand erfolgt ab Werk oder dem nächstmöglichen Lager, welches wir in der BRD oder in anderen europäischen Ländern unterhalten. Im Übrigen ist eine Haftung ohne Verschulden für Verzugsschäden ausgeschlossen.

5.4 Eine Versicherung der Ware gegen Transportschäden erfolgt nur auf ausdrücklichen Wunsch und Kosten des Bestellers.
6. Gewährleistung und Haftung

6.1 Wir gewährleisten, dass unsere Produkte frei von Fabrikations- und Materialmängeln sind; die Gewährleistungsfrist beträgt zwölf Monate ab dem Zeitpunkt des Gefahrüberganges. Unsere Haftung erlischt auch dann zwölf Monate nach Gefahrübergang (Ziff. 5), wenn sich der Versand, die Aufstellung oder die Inbetriebnahme ohne unser Verschulden verzögert.

6.2 Für wesentliche Fremderzeugnisse beschränkt sich unsere Haftung auf die Abtretung der Haftungsansprüche, die uns gegen den Lieferanten des Fremderzeugnisses zustehen.

6.3 Keine Gewährleistung wird übernommen für ungeeignete oder unsachgemäße Verwendung, fehlerhafte Montage bzw. Inbetriebsetzung durch den Besteller oder Dritte, für natürliche Abnutzung, fehlerhafte oder nachlässige Behandlung, ungeeignete Betriebsmittel sowie die Kombination und Vernetzung mit von uns weder gelieferten noch sonst genehmigten Betriebsmitteln des Käufers. Auch die Missachtung von Betriebs¬ oder Wartungsanweisungen, die Änderung der Produkte durch Dritte ohne Genehmigung von uns, sowie die Verwendung von Verbrauchsmaterialien, die nicht der Originalspezifikation unserer Produkte entsprechen, lässt jede Gewährleistung entfallen. Für Mängel auf Grund elektrischer, elektronischer oder chemischer Au¬ßeneinflüsse haften wir nur, sofern uns ein Verschulden trifft.

6.4 Der Besteller hat uns Mängel unverzüglich, spätestens jedoch innerhalb einer Woche nach Eingang des Produktes schriftlich mitzuteilen. Mängel, die auch bei sorgfältiger Prüfung innerhalb dieser Frist nicht entdeckt werden können, sind uns unverzüglich nach Entdeckung schriftlich mitzuteilen.

6.5 Für das Fehlen zugesicherter Eigenschaften und für uns rechtzeitig angezeigte Mängel, die im Zeitpunkt des Gefahrüberganges bereits vorlagen, haften wir in der Form, dass nach unserer Wahl unentgeltlich nachgebessert oder neu geliefert wird, sofern der Mangel die Brauchbarkeit des Produktes erheblich beeinträchtigt. Von den durch die Ausbesserung entstehenden unmittelbaren Kosten tragen wir - soweit die Beanstandung berechtigt war - die Kosten der Ersatzteile sowie die angemessenen Kosten des Aus- und Einbaus und ferner, falls dies ausnahmsweise nach Lage des Einzelfalls aus Billigkeitsgründen geboten ist, die Kosten der etwa erforderlichen Gestellung unserer Monteure und Hilfskräfte. Alle übrigen Kosten trägt der Besteller. Für Ersatzlieferungen, Nachbesserungen und Reparaturen nach dem Gewährlei¬stungszeitraum beträgt die Gewährleistungsfrist sechs Monate.

6.6 Wegen eines angezeigten Mangels sind wir zu dreimaliger Nachbesserung berechtigt. Schlägt die Nachbesserung bzw. Ersatzlieferung fehl, kann der Kunde unter Ausschluss eines Wandlungsrechtes Kaufpreisminderung geltend machen. Im Übrigen haften wir für Schäden nur, soweit es sich um bei Vertrags¬abschluß vorhersehbare, produkttypische Schäden handelt. Für entgangenen Gewinn wird nicht gehaftet. Insgesamt wird die Haftung für Mängel und Schäden auf das Doppelte des Preises des defekten Liefergegenstandes beschränkt. Schadensersatzansprüche aus außervertraglicher Haftung und aus Verschulden bei Vertragsabschluß sind generell ausgeschlossen, ebenso wie Schadensersatzansprüche aus der Verletzung von vertraglichen Nebenpflichten. Wir haften generell nur für Schadenersatz bei Vorsatz oder grober Fahrlässigkeit.

6.7 Wir sind zur Nachbesserung bzw. Ersatzteillieferung nur dann verpflichtet, wenn der Besteller seinerseits seine Vertragsverpflichtungen erfüllt hat.

6.8 Gewährleistungsansprüche gegen uns stehen nur dem Besteller selbst zu und sind nicht abtretbar.
7. Eigentumsvorbehalt

7.1 Wir behalten uns das Eigentum an den gelieferten Waren bis zur vollständigen Bezahlung aller uns zustehenden und noch entstehenden Forderungen, gleich aus welchem Rechtsgrunde, vor.

7.2 Verarbeitung oder Umbildung erfolgen stets für uns als Hersteller. Erlischt unser Eigentum durch Verbindung, so wird bereits jetzt vereinbart, dass das Eigentum des Bestellers an der einheitlichen Sache wertanteilsmäßig (Rechnungswert) auf uns übergeht. Der Besteller verwahrt unser Eigentum unentgeltlich. Ware, an der uns Eigentum zusteht, wird im Folgenden als Vorbehaltsware bezeichnet.

7.3 Der Besteller ist berechtigt, die Vorbehaltsware im ordnungsgemäßen Geschäftsverkehr zu verarbeiten und zu veräußern, solange er nicht in Verzug ist. Die aus dem Weiterverkauf oder einem sonstigen Rechtsgrund bezüglich der Vorbehaltsware entstehenden Forderungen gegenüber allen seinen Kunden bzw. Abnehmern tritt der Besteller bereits jetzt sicherungshalber in vollem Umfang an
uns ab. Wir ermächtigen den Besteller widerruflich, die an uns abgetretenen Forderungen für seine Rechnungen im eigenen Namen einzuziehen. Auf unsere Aufforderung hin wird der Besteller die Abtretung offenlegen und jedem die erforderlichen Auskünfte und Unterlagen geben. Tritt durch die Abtretung eine mehr als zwanzigprozentige Übersicherung des Wertes der Vorbehaltsware ein, so werden wir auf Verlangen die weitergehenden Abtretungen bzw. Kundenforderungen freigeben.

7.4 Bei Zugriffen Dritter auf die Vorbehaltsware, besonders bei Pfändungen, wird der Besteller auf unser Eigentum hinweisen und uns unverzüglich benachrichtigen. Kosten und Schäden trägt der Besteller.

7.5 Bei vertragswidrigem Verhalten des Bestellers, insbesondere bei Zahlungsverzug, sind wir berechtigt, die Vorbehaltsware auf Kosten des Bestellers zurückzunehmen oder gegebenenfalls Abtretung des Herausgabeanspruchs des Bestellers gegen Dritte zu verlangen. In der Zurücknahme sowie der Pfändung der Vorbehaltsware durch uns liegt kein Rücktritt vom Vertrag.

8. Zahlung

8.1 Soweit nichts anderes vereinbart ist, ist Handelsware innerhalb von 14 Tagen nach Rechnungserhalt netto zahlbar. Leistungen (Reparaturen, Montage, Wartung) sind sofort ohne Abzug zahlbar.

8.2 Wir sind berechtigt, trotz anders lautender Bestimmungen des Bestellers, Zahlungen zunächst auf dessen ältere Schuld anzurechnen. Sind bereits Kosten und Zinsen entstanden, so sind wir berechtigt, die Zahlungen zunächst auf die Kosten, dann auf die Zinsen und zuletzt auf die Hauptleistung anzurechnen.

8.3 Gerät der Besteller in Verzug, so sind wir berechtigt, von dem betreffenden Zeitpunkt ab Zinsen in banküblicher Höhe, mindestens jedoch in Höhe von 5% über dem jeweiligen Diskontsatz der Deutschen Bundesbank zu berechnen.

8.4 Kommt der Besteller seinen Zahlungsverpflichtungen nicht vertragsgemäß nach, stellt er seine Zahlungen ein oder werden uns andere Umstände bekannt, welche die Kreditwürdigkeit des Bestellers in Frage stellen, so sind wir berechtigt, die gesamte Restschuld fällig zu stellen, Vorauszahlungen oder Sicherheitsleistungen zu verlangen.

8.5 Der Besteller ist zur Aufrechnung, Zurückbehaltung oder Minderung, auch wenn Mängelrügen oder Gegenansprüche geltend gemacht werden, nur berechtigt, wenn wir ausdrücklich zustimmen oder die Rechte des Käufers unbestritten oder rechtskräftig festgestellt worden sind.
8.6 Mit Vertragsabschluß werden 10% des Gesamtauftragsvolumens als Anzahlung fällig. Die Verrechnung dieser Anzahlung erfolgt mit der Schlussrechnung. Aufträge bis zu einer Gesamtsumme von € 1000,00 (eintausend) sind von dieser Regelung ausgenommen.

9. Schutz- oder Urheberrechte

9.1 Der Besteller wird uns unverzüglich und schriftlich unterrichten, falls er auf Verletzung von gewerblichen Schutz- oder Urheberrechten durch ein von uns geliefertes Produkt hingewiesen wird. Wir sind allein berechtigt und verpflichtet, den Besteller gegen Ansprüche des Inhabers derartiger Rechte zu verteidigen und diese Ansprüche auf eigene Kosten zu regeln, soweit sie auf die unmittelbare Verletzung durch ein von uns geliefertes Produkt gestützt sind. Sodann werden wir dem Besteller grundsätzlich das Recht zur Benutzung des Produktes verschaffen. Falls uns dies zu wirtschaftlich angemessenen Bedingungen nicht möglich ist, werden wir nach eigener Wahl dieses Produkt derart abändern oder ersetzen, dass das Schutzrecht nicht verletzt wird, oder das Produkt zurücknehmen und den Kaufpreis abzüglich eines Betrages für gewährte Nutzungsmöglichkeiten erstatten.

9.2 Umgekehrt wird der Besteller uns gegenüber allen Ansprüchen des Inhabers derartiger Rechte verteidigen bzw. freistellen, welche gegen uns dadurch entstehen, dass wir Instruktionen des Bestellers befolgt haben oder der Besteller das Produkt ändert oder in ein System integriert. Im Übrigen gilt hinsichtlich der Haftung Ziffer 6.5 entsprechend.

9.3 Von uns zur Verfügung gestellte Programme und dazugehörige Dokumentationen sind nur für den Gebrauch des Bestellers im Rahmen einer einfachen, nicht übertragbaren Lizenz bestimmt, und zwar ausschließlich auf von uns gelieferten Produkten. Der Besteller darf diese Programme und Dokumentationen ohne unsere schriftliche Zustimmung Dritten nicht zugänglich machen, auch nicht bei Weiterveräußerungen unserer Hardware. Kopien dürfen - ohne Übernahme von Kosten oder Haftung durch uns - lediglich für Archivzwecke, als Ersatz oder zur Fehlersuche angefertigt werden. Sofern Originale einen auf
Urheberrechtsschutz hinweisenden Vermerk tragen, ist dieser vom Besteller auch auf Kopien anzubringen.
10. Export

Der Export unserer Waren in Nicht-EU-Länder bedarf der schriftlichen Zustimmung, unabhängig davon, dass der Käufer für das Einholen jeglicher behördlicher Ein- und Ausfuhrgenehmigungen selbst zu sorgen hat.

11. Erfüllungsort und Gerichtsstand
11.1 Im kaufmännischen Verkehr ist Gerichtsstand ausschließlich der Sitz der Gesellschaft. Wir sind jedoch berechtigt, auch das Gericht am Sitz des Bestellers anzurufen.

11.2 Es gilt das Recht der Bundesrepublik Deutschland. Die Anwendung des einheitlichen UN-Kaufrechtes (CISG) wird ausgeschlossen.
12. Teilnichtigkeit

Sollten einzelne Bestimmungen nichtig, unwirksam oder anfechtbar sein oder werden, bleiben die übrigen Bestimmungen unberührt und sind dann so auszulegen bzw. zu ergänzen, dass der beabsichtigte Zweck in rechtlich zulässiger Weise möglichst genau erreicht wird. On the website of the Movis Mobile Vision GmbH, users are given the opportunity to subscribe to our enterprise's newsletter. The input mask used for this purpose determines what personal data are transmitted, as well as when the newsletter is ordered from the controller.



The Movis Mobile Vision GmbH informs its customers and business partners regularly by means of a newsletter about enterprise offers. The enterprise's newsletter may only be received by the data subject if (1) the data subject has a valid e-mail address and (2) the data subject registers for the newsletter shipping. A confirmation e-mail will be sent to the e-mail address registered by a data subject for the first time for newsletter shipping, for legal reasons, in the double opt-in procedure. 7. Newsletter-Tracking

If a data subject contacts the controller by e-mail or via a contact form, the personal data transmitted by the data subject are automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the data controller are stored for the purpose of processing or contacting the data subject. There is no transfer of this personal data to third parties.



9. Routine erasure and blocking of personal data


The data controller shall process and store the personal data of the data subject only for the period necessary to achieve the purpose of storage, or as far as this is granted by the European legislator or other legislators in laws or regulations to which the controller is subject to.

    Each data subject shall have the right granted by the European legislator to obtain from the controller free information about his or her personal data stored at any time and a copy of this information. Furthermore, the European directives and regulations grant the data subject access to the following information:




    • the purposes of the processing;

    • the categories of personal data concerned;

    • the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;

    • where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;

    • the existence of the right to request from the controller rectification or erasure of personal data, or restriction of processing of personal data concerning the data subject, or to object to such processing;

    • where the personal data are not collected from the data subject, any available information as to their source;

  • d) Right to erasure (Right to be forgotten)


    Each data subject shall have the right granted by the European legislator to obtain from the controller the erasure of personal data concerning him or her without undue delay, and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies, as long as the processing is not necessary:




    • The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.

    • The data subject withdraws consent to which the processing is based according to point (a) of Article 6(1) of the GDPR, or point (a) of Article 9(2) of the GDPR, and where there is no other legal ground for the processing.

    • The data subject objects to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) of the GDPR.

    • The personal data have been unlawfully processed.

    • The personal data must be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject.

    • The personal data have been collected in relation to the offer of information society services referred to in Article 8(1) of the GDPR.



    If one of the aforementioned reasons applies, and a data subject wishes to request the erasure of personal data stored by the Movis Mobile Vision GmbH, he or she may, at any time, contact any employee of the controller. An employee of Movis Mobile Vision GmbH shall promptly ensure that the erasure request is complied with immediately.



    Where the controller has made personal data public and is obliged pursuant to Article 17(1) to erase the personal data, the controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform other controllers processing the personal data that the data subject has requested erasure by such controllers of any links to, or copy or replication of, those personal data, as far as processing is not required.   • e) Right of restriction of processing


    Each data subject shall have the right granted by the European legislator to obtain from the controller restriction of processing where one of the following applies:

11. Data protection for applications and the application procedures

If the data controller concludes an employment contract with an applicant, the submitted data will be stored for the purpose of processing the employment relationship in compliance with legal requirements. 13. Data protection provisions about the application and use of Google-AdWords



On this website, the controller has integrated Google AdWords. Google AdWords is a service for Internet advertising that allows the advertiser to place ads in Google search engine results and the Google advertising network. Google AdWords allows an advertiser to pre-define specific keywords with the help of which an ad on Google's search results only then displayed, when the user utilizes the search engine to retrieve a keyword-relevant search result. In the Google Advertising Network, the ads are distributed on relevant web pages using an automatic algorithm, taking into account the previously defined keywords.

14. Legal basis for the processing


Art. 6(1) lit. a GDPR serves as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, when processing operations are necessary for the supply of goods or to provide any other service, the processing is based on Article 6(1) lit. b GDPR. The same applies to such processing operations which are necessary for carrying out pre-contractual measures, for example in the case of inquiries concerning our products or services. Is our company subject to a legal obligation by which processing of personal data is required, such as for the fulfillment of tax obligations, the processing is based on Art. 6(1) lit. c GDPR.
In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or of another natural person. This would be the case, for example, if a visitor were injured in our company and his name, age, health insurance data or other vital information would have to be passed on to a doctor, hospital or other third party. Then the processing would be based on Art. 6(1) lit. d GDPR.
Finally, processing operations could be based on Article 6(1) lit. f GDPR. This legal basis is used for processing operations which are not covered by any of the abovementioned legal grounds, if processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data. Such processing operations are particularly permissible because they have been specifically mentioned by the European legislator. He considered that a legitimate interest could be assumed if the data subject is a client of the controller (Recital 47 Sentence 2 GDPR).

Where the processing of personal data is based on Article 6(1) lit. f GDPR our legitimate interest is to carry out our business in favor of the well-being of all our employees and the shareholders.



16. Period for which the personal data will be stored


The criteria used to determine the period of storage of personal data is the respective statutory retention period. After expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfillment of the contract or the initiation of a contract.
